Rulemaking
At their May council meeting, the Council authorized staff to take the steps necessary to finalize the housekeeping changes to Title 463 Washington Administrative Code (WAC). On May 22, 2025, we sent the Concise Explanatory Statement to all those who submitted comments in the 10 months since the changes were first proposed. Staff also filed the CR-103P (WSR 25-12-020) such that the amendments to 24 of the 26 chapters in Title 463 WAC will take effect on June 23.

2020 Air Rule Update
EFSEC accepted public comment June 3, 2020 through July 20, 2020 for the revision of WAC 463-78 – General and operating permit regulations for air pollution sources. The purpose of the proposed rule revisions are to be consistent with Ecology and EPA rules and to ensure that EFSEC issued permits are in line with current EPA and Ecology regulations. Additionally, the Washington Air Quality State Implementation Plan (SIP) is pending update, and requires that EFSEC’s rules be updated to move forward. Because EFSEC would be adopting by reference rules that have already been through public comment via the department of Ecology’s rule making process, this update to EFSEC rules qualifies for the expedited process.
