Rulemaking
A comment period was opened from August 5 through September 24, 2024 for Expedited Rulemaking, RCW 34.05.353, related to administrative housekeeping of the rules in light of recent statutory changes. EFSEC received an objection from Benton County on September 12, 2024. After discussion with the county, the objection was not withdrawn. As a result, EFSEC filed a CR-102 for Proposed Rulemaking (WSR 24-20-147). EFSEC will be collecting public comments from October 16 through November 7, 2024. A public comment hearing will be held virtually on November 7, 2024 at 10am. Check back here for updates in the coming weeks.

2020 Air Rule Update
EFSEC accepted public comment June 3, 2020 through July 20, 2020 for the revision of WAC 463-78 – General and operating permit regulations for air pollution sources. The purpose of the proposed rule revisions are to be consistent with Ecology and EPA rules and to ensure that EFSEC issued permits are in line with current EPA and Ecology regulations. Additionally, the Washington Air Quality State Implementation Plan (SIP) is pending update, and requires that EFSEC’s rules be updated to move forward. Because EFSEC would be adopting by reference rules that have already been through public comment via the department of Ecology’s rule making process, this update to EFSEC rules qualifies for the expedited process.
